Description: A promissory note signed by Vigo and witnessed by Stephen Mitchell was presented. Vigo promises to pay James B. McCall, his heirs or assignees $379 for value received on August 3, 1815. James McCall states Vigo entered into a promissory note where he promised to repay $329 for value received but has failed to do so and he asks for damages. R. Buntin, Clerk, summons Vigo to appear before the judges on the Second day of term May instant. He is to answer to the petition charges of James B. McCall and to bring payment. If he does not bring payment a final judgment will be made against him. B. V. Beckes, Sheriff states he is in obedience to the command and proposes to deliver a true copy of within to the defendant to comply within and acknowledged service of this writ and prevented me from delivery by doing so. The writ is dated May 14, 1816 and signed by B. V. Beckes, Sheriff with cost of copy, mileage and return being $.80. A Petition by James B. McCall, plaintiff is filed. He states in the petition that he holds a note on Francis Vigo, defendant in substance that says 1 day after the date I promise to pay James B. McCall, heirs and assignees $329 for value received August 3, 1815 yet the debt remains due and unpaid therefore he prays for judgment for debt and damages with costs. The writ was issued and filed May 10, 1816 by G. R. C. Sullivan. An appeal bond is filed for Francis Vigo and Toussaint Dubois both of County of Knox, Indiana Territory. They are held and firmly bound unto James B. McCall, his executors, administrators or assignees to which payment well and truly will be made and bind themselves, heirs and administrators on June 12, 1816. The condition of the bond is that they owe James McCall by judgment made May 29, 1816, $379 which the Circuit Court has granted on appeal. If Vigo prosecutes his appeal with effect and abides and performs judgment of General Court then obligations will be void and remain in full form. The bond is signed by Vigo and Toussaint Dubois in front of C. H. Tidlinghart who signed as witness.
