Mills, Henry J. and Joseph O'Neille vs. Nathaniel Harniss, Junior

Description: The file contains twelve documents related to the suit Mills and Oneille brought against Nathaniel Harness, Junior for not delivering on his promised to sell the company eight head of beef cattle. Included one summons, eight subpoenas, one complaint, one plea of not guilty and the accounting sheet for the court cost billing. Nathaniel Harness (Harniss) Junior was summonsed to appear in Circuit Court in Vincennes the first Monday of October 1815 to answer unto Mills and Oneille on a plea of trespass and damages of Three hundred dollars. The summons was witnessed and signed by Robert Buntin, Clerk on the 23 rd of September 1815 and executed by Philip Almy D.S. with $1.79 court fees attached. A complaint was filed by General W. Johnston for Mills and Oneille during the Circuit Court in the October Term. According to the complaint, in August 1815 Nathaniel Harness, Junior, on his plantation near the White River near Vincennes agreed to sell to William Haynie, an agent of Mills and Oneille, eight head of beef cattle for one hundred dollars. The beef cattle were delivered to Haynie with the sum of thirty-five dollars. The Defendant was to receive the rest of the money when he called upon the Plaintiffs in Vincennes. When the agent, attempted to drive the cattle from the Defendants farm to Vincennes, owing to the ferocity of the cattle and the badness of the road, they escaped from the agent and went back to their range in the neighborhood. The agent gave the information to the Defendant and proposed to rescind the bargain due to the difficulty in driving the cattle to Vincennes. The Defendant consented and returned to the agent thirty-three dollars, two dollars having gone to Daniel Decker. The agent then made another agreement with Harness that would allow Mills to decided whether he wanted the cattle or pay the one hundred dollars. When Mills decided he wanted the cattle, Harness refused to sell the cattle. The Plaintiffs were asking for damages of three hundred dollars. At the bottom of the complaint was a notation that Mills and Oneille put in their place General W. Johnston as their attorney. Also noted on the complaint, We the jury find for the Plaintiffs thirty-four dollars and fifty cents in damages. Philip Catt, foreman. Daniel Decker was subpoenaed to appear in Circuit Court in Vincennes on the first Monday in October, the first Monday in March 1816, and twice on the fourth Monday in May 1816. Decker was to give evidence on behalf of both the plaintiffs and the defendant. William Haynie was subpoenaed two times to appear in Circuit Court in Vincennes on behalf of Mills and Oneille on the first Monday of March 1816 and the fourth Monday in May. Howard Putnam was subpoenaed twice to Circuit Court in Vincennes to give evidence on behalf of the Plaintiffs on first Monday of March, 1816 and the fourth Monday of May 1816. Henry Keller and Francis Antis were both subpoenaed twice to appear in Circuit Court on behalf of Nathaniel Harness, Junior on the first Monday of March and on the fourth Monday of May 1816. Thomas Lovens was subpoenaed to appear in Circuit Cout on behalf of Nathaniel Harness, Junior on the first day of June 1816. The last document in the file was a detailed listing of the court costs which totaled $38.08 1/2. According to the Minute Book of the Knox Court Court of Common Pleas/ Circuit Court 1811-1817 page 249 March Term 1816 the parties appeared on a motion ordered that a dedemus do issued to each party to take the deposition of witness before any justice of the peace and the opposite party have sufficient notice, the cause was continued to the next term. Page 290 June Term 1816. the Plaintiffs appeared by Gen. W. Johnston and the Defendant by Henry Hurst. The cause came to a jury: Philip Catt, Charles Boothe, Edward Purcell, William Adams, Manassa Brown, Ephraim Jordan, Saml Parr, James McClure, Abraham Decker, Joseph Voudry, James B. Wheeler, and Robert McDowal. The jury found for the Plaintifsf $34.50 in damages, Philip Catt, foreman. Page 292 Thomas Lovens claimed 3 days attendance in the cause; Daniel Decker claimed 3 days attendance; Wm. Haynie claimed 9 days attendance-6 days at last and 3 days this term.
