United States vs James Dunkin

Description: A recognizance bond of $50 each is issued for James Dunkin and Humphrey Sturman. They are to personally appear at the next court to be held and they are to keep the peace and be of good behavior especially to William Davis of Knox County. The bond was witnessed by James Black with James Dunkin and Humphrey Sturman signing. A summons for James Dunkin and Humphrey Sturman is issued. They are to appear before the judges the 1st Monday of March, next to answer to the recognizance bond entered before James Black, Esquire on January 20, 1814. R. Buntin, Clerk was witness to the bond on February 18, 1815. The bond was executed by James Jordan with service and return being $2.10. The defendant pleads not guilty. The Grand Jurors for the trial were James Hodges, John Setser, James Hannah, Martin Rose, John Kuykendall, Sebastian Frederick, Jr. Samuel Lane, Etheldred Bass, John Thickston, William Lindsay, Isaac Westfall and Joseph Woods. The jury finds for plaintiff and the defendant is found guilty and he is ordered to pay $10.00 cost of prosecuting and enter into a recognizance bond of $50.00 until next term. A new trial is set and during the March 1815 term jurors for the U. S. and the body of the County of Knox upon their oath present that James Dunkin, yeoman, late of the Township of Busseron in the county aforesaid did on the 10th day of February 1815 with force and arms at the township located in Knox County assaulted one William Davis and beat, wound and ill treat him at great damage.. The indictment was filed by William Prince, Prosecuting Attorney. A summons is issued by the U. S. to the Sheriff of Knox County to summon James Dunkin to appear before the judges of the Circuit Court to answer to an indictment for assault and battery. The summons is witnessed by Robert Buntin, Clerk on March 9, 1815 and executed by B. V. Beckes, Sheriff. The Sheriff is commanded to summon William Davis to appear the 1st Monday of June on behalf of the U. S. against James Dunkin on an indictment for assault and battery. A penalty of $100 will be applied for failure to appear. The indictment is witnessed by R. Buntin, Clerk on May 18, 1815. Sheriff B. V. Beckes states that the within was not found in his bailiwick. A subpoena for the defendant Humphrey Sturman, Augusta Latour, James Fowler and Robert Russell is issued. They are to appear the 1st Monday of June next. They are to give evidence on behalf of James Dunkin defendant at the suit of the U. S. A $100 fine will be applied for failure to appear. The summons is dated May 25, 1815 with R. Buntin, Clerk as witnesses. The subpoena was executed for failure to appear on May 25, 1815 per R. Buntin Clerk. The subpoena was executed by B. V. Beckes with service and return being $1.59, 24 miles being $1.44 for a total of $3.03. A subpoena is issued for William Davis. He is to appear the 1st of October to give evidence on behalf of the U. S. against James Dunkin, defendant. A $100 penalty will be applied for failure to appear. The subpoena was issued July 1, 1815 by R. Buntin, Clerk and James Jordan, Deputy Sheriff with cost being $1.74 1/2 for service $.37 1/2, 22 miles for $1.32 and return being $.09. A subpoena is issued for the defendant Humphrey Sturman, Auguste Latour, James Fowler and Robert Purcell. They are to appear the first Monday of October, next and give evidence on behalf of James Dunkin, defendant at the suit of the U. S. A $100 penalty will be applied for failure to appear. The subpoena was witnessed by R. Buntin, Clerk on July 1, 1815 and executed by James Jordan, Deputy Sheriff with service being $1.50, 24 miles at $1.44, and return being $.05 for a total of $2.99. The second Grand Jury consisted of Richard Posey, Walter Neale, Andrew Demaze, Frances Ovelin, Charles Archer, William Armstrong, Daniel Decker, Jacob Pancake, Thomas Owens, Peter Frederick, Sebastian Frederick, and Nathaniel Harnis. They find the defendant guilty and ordered him to pay $5.00 to the Indiana Territory and he is to stand committed until the find is paid.
