Ewing, Nathaniel, for use of Francis Antis vs Henry Hurst and Toussaint Dubois

Description: A promissory note signed by H. Hurst and Dubois witnessed by J. H. ONeille is presented. Hurst and Dubois promise to pay unto Francis Antis the full sum of $100 with interest on or before January 1, next. The note is dated January 13, 1804. The receipt on back states that Francis Antis transferred the note to Nathaniel Ewing on March 25, 1805. The note is signed by Francis Antis and witnessed by John Rice Jones. The principle is given as $10 with interest from December 1806 being $17.50. The total owed is $17.50. A summons is issued to the Sheriff to take Hurst and Tousissant Dubois before the judges of the Court of Common Pleas on Monday March 19, 1810. He is to answer to Francis Antis for the use of Nathaniel Ewing on a plea of $100 debt owed plus $100 damages. The summons is witnessed by Robert Buntin, Clerk on March 17, 1810, $100 bail is required and the summons was executed by John McCandless. A recognizance bond is filed by Henry Hurst and John McCandless who are held unto Permenas Beckes, Sheriff in the sum of $100 on March 19, 1810. The bond is signed by Jonathan Caldwell, H. Hurst and John McCandless. A complaint is filed by Nathaniel Ewing assignee of Francis. He complains of H. Hurst and Toussaint Dubois that they render unto him $100 which they have owed him since January 13, 1804. He states he also promised to repay the debt with interest on or before the first of January next, but he has failed to do so as of March 25, 1810. He also states that by the signature of Francis Antis he did assign over to direct the contents to Nathaniel. He also states that for reasons there for the statue of such is now made and provided to be the plaintiff and the defendant H. Hurst and Toussaint Dubois now owe the debt to Nathaniel and puts in his place General W. Johnston. Nathaniel, plaintiff, by his attorney suggests that the copias ad respondeum for the case came from the Clerks office. The copias was delivered by the Sheriff on one of the defendants H. Hurst and Toussaint Dubois by non est inventus according to the form of the state. A reply by Johnson, P. Q. is filed that states Frances states H. Hurst has not paid and satisfied the debt stated in the declaration. The defendant response by Hurst states he has paid and satisfied the debt owed and can verify this. A subpoena for Toussaint Dubois, Jacob Kuykendall and Mark Barnett is issued. They are to come to court now and give evidence on behalf of Nathaniel Ewing, assignee of Francis Antis against Henry Hurst. A $100 fine will be applied for nonappearance. The subpoena is witnessed by Robert Buntin, Clerk and executed by B. Beckes, Deputy Sheriff with the cost to service listed as $1.21 1/2. A receipt is filed, dated September 1811 and sent to the Sergeant in command of the boat, assigned to the U. S. Troops. The Sergeant is commanded to ascend the Wabash with baggage and take on board for Mr. Brouillette one barrel and one keg. The note is signed by H. Hurst, Aid de Camp is issued to the Commander in Chief September 24, 1811. Court fees from August 15, 1807 to April 1809 in the amount of $18.05 and Sheriff fees in the amount of $6.34 are filed. Court fees from 1811 are filed in the amount of $21.39.
