Comer, Daniel vs United States

United States vs Daniel Comer

Description: This file contains an indictment and a summons related to a court case in which Danile comer was charged with assult and battery. The indictment notes that Daniel Comer, a yeoman, did beat and wound William McGowen and is signed by Thomas Randolph, Attorney General for Indiana Territory. The verso of the indictment indicates that Comer pleaded not guilty and the jury found him guilty. The summons calls for Wrexham Ellis to give evidence against Comer. The summons was witnessed and signed by court clerk Robert Buntin on July 31, 1810 and executed by sheriff John McCandless for 46 1/2 cents. According to the Minute Book of Common Pleas, 1807-1810, pages 254-255, the jury did find the defendent guilty but his attorney John Johnston called for a new trial because the jury had the laws of the territory with them on retirement and the court agreed. The defendent than came forward and confessed to the cahrges and was fined 25 cents, which he paid.
