United States vs William Price

Description: This file contains 4 summons and 1 indictment in a case brought against William Pierce for assault and battery on June 26, 1809 upon Elijah Tubbs. The indictment notes that the assault took place on the road between the houses of David Price and William Dearborn and was signed by Attorney General Thomas Randolph. The third summons called for Elijah Tubbs to appear before the court on the third Monday of March 1810. The summons was witnessed and signed by court clerk Robert Buntin on March 17, 1810. Deputy sheriff John McCandless could not locate Tubbs. The last summons calls for William Pierce to appear on the third Monday of March 1810 and was witnessed and signed by court clerk Robert Buntin on February 28, 1810. The summons was executed by deputy sheriff John McCandless at a cost of $1.66 1/2 cents. According to the Minute Book of the Court of Common Pleas 1807-1810, page 234, there was a motion by the Attorney General Thomas Randolph to continue the case the next tern, but the attorney for the defendant, General Washington Johnston, argued successfully that the case should be dismissed.
