A summons for James Adams to come to court to give evidence on behalf of Abraham Defrance, agent of Nimrod Dawson on a plea of trespass is filed. The summons is witnessed by R. Buntin, Clerk, on 19 March 1806. The cost of law being .46 1/2. The summons was executed by P. Beckes, Sheriff. Abraham Defrance appears before Henry Vanderburgh, Judge of Indiana Territory and makes an oath that Nimrod Dawson is indebted to him in the sum of $70 and John Daughtery in the sum of $40. The oath is sworn on 21 August 1806. On the reverse it states that affidavit is for $70, writ $21 and is dated August 1806 plus damages of $100. Also listed is damages of $100 plus writ for John Daughtery for $60 and affidavit is $40. A summons for Nimrod Dawson to come to court the last Monday in November on a plea of trespass and damages of $100 owed to Abraham Defrance is issued. The summons is executed by Abraham Defrance on 21 August 1806. The cost of law is $1.30 1/2. A statement that the affidavit is filed in the sum of $70 and bail is requested is signed by R. Buntin, Clerk. The defendant moves to squash the writ by Johnson A. D. on the grounds that at the time Defrance was Deputy Sheriff. and should have had someone else execute the writ. The court overruled the motion. Nimrod Dawson & Joshua Jordan are bound in the sum of $200 on 22 August 1806. They are to appear the first Tuesday, November 1806 on a plea of trespass & damages of $100 to said Abraham Defrance. The document is signed Nimrod Dawson, Joshua Jordan, in the presence of James Adams. Abraham Defrance complains of Nimrod Dawson, defendant and says he is indebted for $49.55. The plaintiff states he has received no payment or damages. Abraham Defrance puts in his place General W. Johnston. the defendant appears & pleads non assumpsit. Signed John Johnson, Attorney for the defendant. A document dated 15 August 1807 shows cost for $22.32. A court cost bill is filed for $18.10. |
