This file contains the documents related to the case Joseph Decker, Senior, brought against Charles Carrico [Carico] in the Knox County Court of Common Pleas in 1805. In the complaint file by the Plaintiffs lawyer, General W. Johnston, in October 1805, Decker delivered to Carrico a bay mare, a cow, a calf, and 250 weight of pork. In exchange, Carrico gave Decker a black horse that was supposed to be sound and of good health. According to Decker, the black horse was blind and unserviceable. Decker valued the mare, cow, calf and pork at $120, and wanted compensated. The Defendants response through his attorney, John Rice Jones, was that he did not under take or promise in the manner stated in the complaint. A summons was issued for Charles Carrico to appear in the Knox County Court of Common pleas at the February Term. He was to answer to the complaint filed by Joseph Decker. The summons was issued by Robert Buntin, Clerk. The summons was executed by Abraham Defrance, Deputy Sheriff for Sheriff Daniel Sullivan with fees totaling $1.07 James Crow, Nancy Decker, Joseph Johnson, and Thomas Thompson were summoned to appear at the July Term 1806 on behalf of Joseph Decker, Senior. Robert Buntin, Clerk, issued the summons and it was executed by Abraham Defrance, Deputy Sheriff. The fees were $3.99. Thomas Thompson, William Noy, and Miss (Peggy) Pea were summonsed to appear to testify on behalf of Charles Carrico. Robert Buntin, Clerk, issued the summons and it was executed by Abraham Defrance with fees of $1.08. The parties then agreed to go to arbitration with Thomas Jordan [Jourdan] and Abel Westfall. William Noy and Peggy Pea were summoned to appear at the arbitration conducted by Thomas Jordan[Jourdan] and Abel Westfall at the house of Ephraim Jordan [Jourdan]. The arbitration resulted in a Judgement for Joseph Decker of $42.00 in damages against Charles Carrico on October 24, 1806. The ledger of court cost was $20.47 added to the $42.00 totaling $62.47. |
