John Thompson vs Daniel Smith

Description:	The transcript of an arbitration for John Thompson vs Daniel Smith, written by Robert Buntin. November 30, 1808, John Thompson appeared in court with a submission of an arbitration and award that was read and asked that the court might rule. Both John Thomas and Daniel Smith agreed to an arbitration by James Scott, Abraham F. Snapp, and John Durrum. This agreement was witnessed by Daniel McClure and William Shepherd. On October 21, 1808 the arbiters stated, We do award and order that Daniel Smith shall pay John Thompson four hundred dollars, two hundred in cash and the balance in horses and cattle at the common trading price. Signed, Abraham F. Snapp and John Durham. Witnessed by Daniel McClure and George McClure. A receipt was written, Received of Daniel Smith in consequences of the within award two hundred dollars in trade I say received of him by me this 17th day of November 1808. John F. Thompson. Test Noah Purcell and Ephraim Jordan Daniel McClure one of the witnesses to the award, was sworn in court and gave testimony. John Durham was chosen by the arbitrators as an umpire after they could not agree, and the award was delivered to the Parties. The award was filed of the Record and the cause continued. December 1, 1808, the parties appeared and the Defendant asked that the award be set aside. The Court on examining the papers and the Law on the awards, ordered that the award be set aside
