On January 15, 1819, Hyacinth Lassalle by his attorney Thomas Blake brings suit against Jonathan Batron. The writ is to recover the portion of the judgement obtained from him in a case filed in April 1818 of General W. Johnston vs Hyacinth Lassalle where the judgement amounted to $293.57 1/2, and was paid by Hyacinth Lassalle. The suit was founded on the administration bond of Jonathan Marney administrator of William Blundel to which bond he and Jonathan Batron were jointly obligor. A copy of notice dated January 18, 1819 was given to Deputy Sheriff S. Almy to execute, on the back the following was recorded, returned without being executed by order of the plaintiffs attorney, January 20, 1819. On January 28, 18120 a notice was filed in the clerks office by plaintiff, stating to the defendant that in the February 1820 term he will be making a motion for judgement on the portion due him for the April 1818 judgement of $293.57 1/2. The notice was delivered on January 28, 1820 to defendant by Deputy Sheriff S. Almy. During the February term it was decided plaintiff be awarded $97.85 1/2, a 1/3rd of his part of the $293.57 1/2, together with his costs and charges. Hyacinth Lassalle did on April 8, 1817 duly sign and execut a bond of conveyance for certain lands which bond in words and figures stated that H. Lassalle did pay to Jonathan Marney his heirs and assignees the sum of $1000. Lassalle does make unto the heirs of Jonathan Minor a good and sufficient deed of 200 acres of land N.E. half of lot 47 in the additional donation in Knox County being security bond for said Jonathan Marney as administrating bond for the estate of William Blundel, the debt as administrator was satisfied by Lassalle and paid to Marneys heirs, set to hand April 1817. The sale of property was to William Hollingsworth. The court did determine that Lassalle should recover his proportional share of sums he paid upon the administrator bond. The defendant by court asks for wave and except the signed and sealed bill of exceptions dated March 14, 1820, witnessed by Judge J. Doty. A certified copy was delivered to Moses Tabby on March 18, 1820 by Deputy Clerk C.H. Tellinghart. |
