Folder 3185 in Box 58 of Knox County Circuit Court records at the Knox County Public Library’s McGrady-Brockman House contains seven documents in the case of Butler vs. Steam Mill, 1823. This case was a continuance of the case found in folder 2969 in Box 53. Jack Butler, a man of color who had delivered several loads of stone to the steam mill with the agreement of payment from the owner of the mill was never paid. After the death of the owner, the remaining partners were billed as agreed but refused to pay, thus Butler sued them for the amount owed him. Documents appear to relate to two cases. The first in which a Knox County jury finds for Butler. The second, in 1823, in which the Indiana Supreme Court overturns the Knox County decision. Documents include an appeal by the partners of the mill of the circuit court ruling in 1822, notices to partners that depositions would be taken from witnesses for Butler, depositions of witnesses, order to any Justice of the Peace in Lawrence Co., Illinois to examine witnesses for Butler, subpoena for the defendants, and an undated jury verdict finding for the defendant, presumably in the Knox County case and a decision from the Indiana Supreme court overturning the first verdict. |
