Wallace, Jr. George vs. William Prince and Benjamin Beckes administrators of Parmenas Beckes estate

Description: The file contains eight documents related to the suit George Wallace, Junior brought against William Prince and Benjamin Beckes the executors of Parmenas Beckes estate for the unpaid debt on two promissory notes. Included in the file are two promissory notes, three summons, one petition, one response, and the court cost account. The first promissory note was written to George Wallace, Jr. by P. Beckes. It promised to paid one day after date one hundred fifty-six dollars and twenty cents for value received on January 22, 1811 and witnessed by N. Claypoole. On the verso, January 6, 1813 received on account one hundred dollars from his father. $100. The second promissory note was written to George Wallace, Jr promising to pay one day after date, one hundred ninety-one dollars and thirty-four cents for value received on January 30, 1812. This note was witnessed by Irwin Wallace. A summons was issued for William Prince and Benjamin Beckes, executors of Parmenas Beckes, deceased to appear before the judges of the General Court to be held in Corydon in the county of Harrison the first Monday in September next to answer unto George Wallace in a plea they render unto him the sum of three hundred and forty-seven dollars and fifty-four cents which they unjustly detained and damages of five hundred dollars. The subpoena was witnessed and signed by Henry Hurst, Clerk General Court on August 6, 1814, On the verso We acknowledge, the service here of Aug. 5, 1814. W. Prince and B.V. Beckes. In a petition to the clerk of the Circuit Court Knox County, George Wallace, Jr. petitioned that he held two notes of Parmenas Beckes now deceased of whom Prince and B. Beckes are the executors and Defendants. Copies of the the two promissory notes were included. The Plaintiff then stated the debt had not been paid and asked for judgment and damages. Signed George Wallace, Jr. February 15, 1815. In response to the petition, Prince and Beckes by John Johnson, their attorney, defended the wrong and injury and stated Wallace should not have brought the suit and that Parmenas Beckes before his death fully paid and satisfied the debt and demand and they were ready to verify and prayed judgment. On the verso, the Plaintiff by his attorney, G.W. Johnston, P.Q., said that the debt had not be paid and asked for an inquiry by the country. A second summons was issued for Prince and Beckes and they were to appear in the Knox County Circuit Court the second day of March Term 1815 to answer to the Petition of George Wallace Jr. This Summons was issued by Robert Buntin, Clerk, CCKC on February 16, 1815. A copy of the two promissory notes were included. On the verso, come to hand the 4th of March executed by delivering the defendants a copy on the 6th Inst. H.I. Mills, Coroner. Also noted, We of the jury find for the Plaintiff the debt to be discharged by the payment of two hundred and forty-seven dollars and fifty-four cents debt and sixty-four dollars ninety-three cents in damages. Daniel McClure, foreman. A third Summons was issued for Prince and Beckes to appear in court. This time they were to appear before the judges of the court in Vincennes on the second day of June Term next to answer to the petition of George Wallace, Jr. This Summons was issued by Robert Buntin, Clerk, CCKC March 20, 1815. Included were copies of the notes and request for payment of debt and damages. This writ was executed by delivering a true copy to each of the Defendants on the 10th day of April 1815 Henry I. Mills CKC. The last document was the accounting of the court cost fees that totaled $15.85. According to the Minute Book of the Knox County Court of Common Pleas/Circuit Court 1811-1817 page 164: June Term 1815 on Pleas payment and joiner. The jury: Daniel McClure, William Lindsey, Saml; Lane, Thomas Palmer, Will Garran, William Purcell, Sebastian Frederick, James Denny, Nathaniel Harniss, Thomas Holder, Abraham F. Snapp, George a McHenry found for the Plaintiff the debt to be discharged by payment of two hundred forty seven dollars debt and sixty-sour dollars and ninety three cents in damages.
