The file contains the indictment and summons related to the suit the United States brought against John Hodge for his assault and battery of Mary Devore, widow. During the July Court of Common Pleas Term 1819, Thomas Randolph, Attorney General for the Indiana Territory presented to the Grand Jury, charges that John Hodge, yeoman on the 13th day of July 1810, with force and arms with and upon Mary Devore, widow, did assault, beat, wound and ill treat her so that her life was greatly despaired of and other wrongs against the peace and dignity of the United Sates. On the verso of the Complaint, A True Bill, Walter Wilson, foreman, United States prosecutor A Summons was issued for Mary Devore and John Devore to give evidence to the Grand Jury now sitting. It was issued on July 13, 1810 by R. [Robert] Buntin Clerk CPKC. On the verso of the Summons was written I deputize Robert Johnston to execute the writes. Jno McCandless, Sheriff. Also written was executed John McCandless, Sheriff with $1.32 added court costs for serving the Summons. A second Summons was issued for Mary and John Devore to testify the first Monday of January 1811. They were to testify on behalf of the United States, against John Hodge, Defendant on the indictment for assault and battery on Mary Devore, widow. The Summons was issued by R Buntin, Clerk CPKC, January 4, 1811. On the verso side, not time to execute. Jno McCandless, Sheriff. A third Summons was issued for Mary and John Devore to testify against John Hodge. It was issued July 29, 188 by R. Buntin. This Summons was executed by B [Benjamin] Beckes, with court costs of $1.13 added. The fourth Summons for Mary and John Devore was issued for the 2nd Monday of December 1811. They were again to testify for the United States in the suit against John Hodge. The Summons was issued by R. Buntin on December 2, 1811. This Summons was executed by Jno. I. Neely, D. Sheriff. According to the Minute Book of Common Pleas 1807-1810, page 254, John Hodge was indicted. In the Minute Book of the Knox County Court of Common Pleas 1811 - 1817, pages 3, 12, and 32; the case was continued until the November Term 1811, when Gen. Johnston, for the United States reported, he would no longer prosecute the indictment. It was ordered that the Defendant pay costs. |
