Jurors hear testimony from Thomas Randolph, Attorney General who states David, yeoman of Knox County Indiana Territory did on Monday, June 26, 1809, on the road between the houses of David Price and William Deacon beat and assaulted Elijah Tubs, yeoman. Thomas Randolph states these actions are contrary to the nature of the Territory. A subpoena dated November 20, 1809 and signed by R. Buntin, Clerk is filed. A subpoena dated November 8 1809, for Elijah Tubbs to come to court the last Monday of November instant is filed. He is to give evidence against David Price, defendant on a plea of assault and battery. A $100 penalty will be applied if he does not appear. The subpoena was executed by John McCandless, Deputy Sheriff with cost to serve listed as $1.84 1/2. A subpoena dated November 20, 1809 and signed by R. Buntin, Clerk is filed. The subpoena is for David Price to appear the last Monday of November instant to answer to an indictment against him for assault and battery committed on the body of Elijah Tubbs. The jury finds the defendant not guilty. |
