Polk, Edmond vs Thomas Melton

Description: A summons is issued by Daniel McClure against defendant on a note for $30 on April 17, 1809. Thomas Melton defendant appeals to John Small against the judgement. In the appeal John Small acknowledges that he felt a special bail in the sum of $60 should be levied on goods and clothes of the defendant if he is in default. He is to come to court the first day of May instant. The summons is signed by John Small on April 17, 1809, A complaint in an action of covenant broken is filed by Edward Polke assignee of Henry Smallwood who complains of Thomas Melton on a plea of covenant broken on August 26, 1807. He states Henry Smallwood was promised by Thomas Melton that he would pay $15 in cash and $15 in store goods within the 18 months from the date to wit October 19, 1808. He asks for the amount due and damages of $50. Edward Polke assignee of Henry Smallwood puts in his place General W. Johnston, attorney against Thomas Melton on an action of covenant broken. Thomas Melton signs the promissory note for cash $15 in stores and paid back in 18 months from the date of August 26, 1807. The note was signed by Daniel McClure and witnessed by William McGowen. On the reverse of the note Henry Smallwood signs stating he hereby assigned all rights and titles of the Melton note to Edmond Polke for value received. The document was signed before Daniel McClure and witnessed by William Bruce. A summons is issued for Daniel McClure, Esq. to come to court the last Monday of November 1809 to give evidence on behalf of Edward Polke against Thomas Melton on a plea of debt. The summons was signed 25 November 1809 and was executed by John McCandless.
