A promissory note signed January 11, 1807 at Vincennes by Joseph Barron to Jean Bte. LaPlante. Joseph Barron indebted himself in the amount of $85 to Jean Bte. Laplante who he promised to pay in divers, goods, wares, merchandise and flour. He is also asking for $150 in damages. The complaint is filed July Term 1808. A notation on back states that Jean Bte. Laplante puts in his place General W. Johnston as his attorney in an action of trespass. A summons is issued for Joseph Barron to come to court on a plea of trespass and damages of $150. The summons is dated May 6, 1807 and signed R. Buntin, Clerk. A notation states that taxes are paid, and the summons was executed by P. Beckes, Sheriff with a cost to serve being $1.90. William Prince was to pay bail. Also a note states that this action is brought on 2 notes at hand therefore the sheriff will take $45 for bail. The summons is signed R. Buntin, Clerk. Bail is required of Joseph Barron and William Prince. They are bound unto Permenas Beckes for $45 on May 9, 1807. They are to appear the last Monday in July to answer unto John Bte. Laplant on a plea of trespass and $150 in damages. The bond is signed by Joseph Barron and William Prince and executed and delivered by Ephraim Jordon. An affidavit is filed by the plaintiff. He puts in his place General W. Johnston on a plea of trespass for $85 and $150 in damages that are owed to Jean Bte. Laplante by Joseph Barron. On September 1, Laplante by his attorney continued the case to October next. The defendant did not appear. Judgement was by default and entered against the defendant and William Prince lost his bail. The continuance November 13, 1807 and defendant by H. Hurst and a motion of Habeas Corpus from the General Court was read on a motion of defendant. The Sheriff is commanded to take Joseph Barron into custody and bring him to General Court the first Monday in April 1808. The summons is dated December 4, 1807 by H. Hurst, Clerk. A note by Henry Vanderburgh states that the writ is to be sealed. R. Buntin, Clerk is ordered to make a copy of the proceedings in the case and return it with a writ of Habeas Corpus to the judges of the General Court on March 16, 1808. The cost of county, clerk and sheriff is $11.08 1/2. A summons to the judges of the Court of Common Plea and Sheriff of Knox County to bring Joseph Barron to prison or into your custody and bring him before the judges of the General Court the first Tuesday, April, next. The summons is signed November 8, 1808 by H. Hurst, General Court, Clerk. Attorney fees are filed for $8.99. A receipt showing the amount owed and payable April 7, to December 1808 with interest is filed for $47.00. 2 barrels of flour, plus due bill in the amount of $10.56 with interest from May 1807 to December 8, 1807 for $.98 for a total due in the amount of $58.44. A cost of court bill is filed for 1807-1808. A cost of court bill from 1807-1808 plus judgement in the amount of $83.45 1/2. |
