The file contains two documents regarding the suit Julie Campeau Chartier (for the use of Francis Vigo) brought against Ebenezer S. Platt for failure to pay for a mortgageed property. One document was a Summons for Ebenezer S. Platt to appear in the Knox County Court of Common Pleas on the last Monday in July to answer to charges of failing to pay the mortgage. According to the Summons, Ebenezer S. Platt did by deed March 25, 1786 take out a mortgage for a tract of land from Jean Baptist Chartier and his wife Julie Campeau. The tract of land of two arpents in the front and forty arpents in depth, had a house, barn, and other buildings and situated on the north side of the river S. Jerome (or Wabash) opposite the town of Post Vincennes. They were to receive payments of two thousand livers in peltry to be paid the first day of July in the said year and the next ensuing or to the bearer of the said mortage on pain of all expenses, damages and interest. Julie Campeau Chartier, now a widow, stated it had been a long time since the two thousand livres wer to have been paid. The Summons was written by R [Robert] Buntin, Clerk CPKC on July 11, 1808, Deputy Sheriff, Samuel Hayes wrote, could not execute the summon is not to be found in my bailiwick. On the back of the Summon, Jurors find for the Plaintiff, the sum of $746.66 2/3 in damages. Domnique La Croix The second document lists the court costs which totaled $17.13. According to the Minute Book of the Knox County Court of Common Pleas, 1807-1810; page 88, The Plaintiffs attorney, John Rice Jones ordered that an alias do issue returnable to the next term of July. Minute Book p. 128; The Plaintiff appeared by John Rice Jones the Defendant did not appear. The jury consisted of: Domnique LaCroix, Laurence Bazadone, Francis Vally, Jacob Miner, John Youngman, Charles Thorn, Joseph Hollingsworth, Michael Thorn, John Wallace, John Marshall, Henry Ruble and Abraham F. Snapp. They found for the Plaintiff damages of $746.66 2/3. A writ of levari was to be issued to proceed with the execution of the judgement. |
