The file contained the documents related to the suit General W. Johnston brought against Jacob Fleehart on a plea of Trespass in the Knox County Court of Common Pleas in 1807. In the Declaration, Johnston filed during the March Term 1807, he asked for an attachment against Fleeharts property and goods for an unpaid debt of $25.87. He also asked for $100 in damages. On the reverso, We of the jury find for the Plaintiff $34.40 in damages, signed Wm(William) Prince, foreman. A second document, was a summons to attach the goods and property of Jacob Fleehart signed by Robert Buntin, Clerk. The summons was executed by P (Parmenas) Beckes. On the reverso, In presence of Samuel McConnel and Samuel Hays, I, Parmentas Beckes, have attached a lot in Vincennes opposite the house of Labimere. February 18, 1807. In an affidavit for attachment, Johnston, swore before, (Elihu) Stout, Justice of the Peace, that Jacob Fleehart was indebted to him the sum of $25 by account and that Fleehart was not a resident in the Territory. A fourth document, signed by GW (General Washington) Johnston, to the Clerk of this County Court of Common Pleas: Attachment Dam $100; Retble to March Term 1807; Tax paid, 16, February 1807. A subpoena was issued for William Prince and William McIntosh to appear in court on March 21, 1808 to testify on behalf of General Johnston. It was signed by Robert Buntin, Clerk and executed by Samuel Hays, Deputy Sheriff with $.84 fees attached. Three newspapers notices were placed in a Louisville newspaper during April 1807 regarding the attachment of Jacob Fleeharts property for debt to General Johnston. The listing of the court costs and damages, $25.73, $34.40 (verdict) equaled $60.12. According to the Knox County Minute Book of the Court of Common Pleas 1807-1810, p. 77; The Plaintiff appeared but the Defendant did not appear. The jury included: William Prince, John Stillwell, James McClanahan, William V. Moreman, Robert Falls, John Smith, Isaac Knight, Robert M. Evans, Elias McNamee, Luke Decker, Jr, Isaac Montgomery, and Daniel Gregory. The verdict found for the Plaintiff for $34.40; jury fees to be paid for by the Plaintiff. William Prince and Elias McNamee acknowledged themselves security in double to the sum recovered. |
