Alvin and Lucinda Tracy vs Margaret Thor

Description: The file contains the documents related to the petition of Alvin and Lucinda Tracy to partition the real estate of Samuel Thorn with the heirs and life estate of his widow Catherine Thorn. Included documents are the petition, request for summons, summons, appointment of commissioners, oath of commissioners, guardian ad. litems report, the commissioners report of the partition and the court report. During the May Term 1846, Alvin (in the right of his wife, Lucinda) and Lucinda Tracy petitioned the court to partition real estate they held in common with William and Margaret Thorn minors and heirs of Samuel Thorn deceased and in a life estate of Catherine Thorn, widow of Samuel. Some of the property was described as 40 feet front on Second Street of Lot No 81 and extending back same width the whole depth of said Lot in Borough Vincennes part of Lot No. 34 purchased by Samuel Thorn, deceased, of George W. Wilkerson which descended to the heirs of Samuel Thorn in five equal parts. Lucinda, Margaret, William, Benjamin and Thomas Thorn. Alvin Tracey purchased the properties inherited by Benjamin and Thomas Thorn. Also twenty four feet front on Water Street of Lot No. 20 in said Borough and extending back the same width to the Wabash River. Also 26 feet front on Market Street Lot No. 62 and remaining back the same width the full depth of said lot. Also Lots Nos. 444, 461, 491, 492 in Borough of Vincennes. Attorney Abner T. Ellis represented the Plaintiffs. A request was made by A. T. Ellis to summons William Thorn and his guardian, Mary Ann Thorn and Margaret Thorn and her guardian, Nicholas Smith, to the May Term Probate Court. The summons for William Thorn, Mary Ann Thorn, Margaret Thorn and Nicolas Smith were issued by W.R. Mc Cord, Clerk, and executed by Isaac Mass, Sheriff. Fees of $1.96 were attached to the summons. In the Court Report written by W.R. Cord, Clerk, David S. Bonner, Thomas Bishop, and William Heberd were appointed as Commissions and were to write a report on partitioning the real estate. W.R. McCord was appointed as guardian ad. litem for the minor children and was to write a report to court regarding the partition. The answer of the guardian ad. litem, was that he could see no problem with the partition. In the Court Report, the commissioners swore to uphold their job in a faithful manner and signed their deposition. Abner T. Ellis witnessed the oath. The Commissioners Report: Margaret Thorn the full of her interest is the remainder of the life Estate of Catherine Thorn, Forty feet front on Second Street of Lot No. 81. William Thorn, over twenty one feet front on Market Street and extending back the same width the full depth of Lot No. 62 it being the north west part of said twenty six feet. Alvin and Lucinda Twenty-four feet front on Water Street of Lot No. 20 and running back the whole depth of said lot to the River Wabash. The remainder after the life estate of Catherine Thorn, part of Lot 34 being the same purchased by Samuel Thorn of George W. Wilkerson. Five feet front on Market Street of Lot No. 62 winding back the width the full depth of said lot being off the South East side of said 26 feet of said Lot No. 62. Also the Lot No. 444, 461, 491 and 492. Signed D.S. Bonner, Thomas Bishop, and William J. Heberd: Commissioners. The attached fees of $3.00 per commissioner and $10.00 court costs. Court fees allowed by James Thorn.
