James Neal vs Sarah Neal, William Neal, Ira Neal and Charlotte Neal 1849

Description:	The file contains the petition of James Neal to partition the Donation lot #139 between the heirs of Wilson Neal. Included is the petition, summons for the heirs, the guardian ad. litem report, the Commissioners report, a map of the partition and a receipt. In 1848, attorney Allen, filed a petition for James Neal to partition part of Donation Lot #139. He asked for Commissioners to be appointed to assess and evaluate the land for partition. On the back of the petition, was a note to issue summons to the heirs of Wilson Neal. The summons for Sarah, Ira, Charlotte,and William Neal was issued by W.R. McCord for the March Term 1849. It was executed by A.P. Scott, Deputy Sheriff for William Scott, Sheriff. $3.12 fees were included for executing the summons. A report by W.R. McCord, the guardian ad. litem for Sarah, Ira, and Charlotte Neal, stated he knew nothing that should stop the partition. According to the Court Report of W.R. McCord, the heirs of Wilson Neal should each receive 1/5 of the land partition. The land described as Part of Donation 139, town four (4) North Range Eight (8) West containing 200 acres. An order was made to have the land partitioned fairly by appointed Commissioners: Joseph Hague, Harmon Robinson and George Calhound. The Commissioners Report recommend Sarah Neal receive Lot # 4 with 38.64 Acres, James Neal Lot # 3 with 57.96 acres, William Neal Lot # 2 with 49.89 acres, and Ira Neal Lot # 1 with 33.64 acres. A detailed map by George Calhound, surveyor, was included with neighboring farms Tobias Pickel and John Chansler. Also included in the file was a receipt of Thomas Overbay, one of the heirs of the real estate of Wilson Neal for fur dollars and fifty cents signed by H.B. Robinson a Commissioner.
