Abraham F. Snapp vs Etheldred Bass

Description: Court Transcript written by Robert Buntin of the suit Abraham Snapp brought against Etheldred Bass for Trespass and asking for damages of one hundred dollars. November 13, 1801 Abraham Snapp sued for a writ of Capias ad respondenum against Etheldred Bass in a plea of Trespass. The writ was witnessed by James Johnson and executed by William Prince, Sheriff. February Term 1802, Abraham Snapp appeared with his attorney, Robert Hamilton and Etheldred Bass was represented by Benjamin Parke. On a motion of the Defendant, the said Plaintiff, ruled to file his count or Declaration by May Term. May Term 1802, the parties and their attorneys appeared. The Plaintiff filed his Declaration, Etheldred Bass was attached to answer Snapps plea of Trespass. In March of 1801, Bass was indebted to Snapp for the sum of one hundred three dollars and fifty four cents for diverse goods wares and merchandise. He had not paid the debt although often requested. On a motion of the Plaintiff, the Defendant was ruled to file his plea or answer to the count at the next Term. August Term 1802, the Defendant by Benjamin Parke filed his plea: Etheldred Bass ads Abraham Snapp . The promises and the verdict: They found for the Plaintiff, ninety-four dollars and sixty-eight cents in damages. Signed Abraham Westfall, foreman. It is considered that Abraham F. Snapp do recover of the said Etheldred his damages and also twenty-nine dollars and nineteen and one half cents for his cost and charges. Damages in the whole amount to one hundred and twenty-three and eighty-seven and one half cents. The Defendant excepted to the evidence given by the Plaintiff and filed a bill of Exception. Etheldred Bass adverse Abraham Snapp The plaintiff offered in evidence to support his action that a conveyance of a certain tract of land was made to the Defendant by Pierre Gamelin. The price being eighty dollars. This action was brought to recover, without its appearing in the Plaintiffs Declaration. That any privity of contact between Pierre Gamelin and the said Plaintiff either by assignment, agreement, request or in no wise whatever subsisted between Snapp and Gamelin. To which the Defendant undertakings, he did not undertake and promise in manner and form as stated in complaint, Parke. The Plaintiff by Robert Hamilton, case continued to the next Term. November Term 1802, both parties and attorneys appeared, the cause was continued to the next Term in February. February Term 1803, the parties and attorneys appeared, the Plaintiff joined Issue on the plea. A trial was scheduled for May 1803. May Term 1803, Abraham Snapp, by General Washington Johnston, Etheldred Bass by Benjamin Parke appeared. On a motion the cause was continued until evening, on further motion, the cause was moved to Saturday the Fourteenth. Jurors: Abraham Westfall, Jeremiah Claypoole, Isaac Decker Jr., John Durham, George Spoar, Charles Floyd, John Elsworth, Benjamin Bullet, Ephraim Jourdan, William Welton, John Harbin and Michael Thorn. They found for the Plaintiff, ninety-four dollars and sixty-eight cents in damages. Signed Abraham Westfall, foreman. It is considered that Abraham F.
