Theophilus Phillips vs Eliza, Charles and John Marquand heirs of Solomon Marquand

Description: A petition by Theophilus Phillips is filed in court stating he is a proprietor of one undivided half part belonging to Eliza Marquand, widow and Charles and John Marquand, children and minor heirs of Solomon Marquand, deceased. The land amounts to 200 acres. 104 acres border Peter Barger, 50 acres border Henry Woodland, 44 acres border the estate of Joseph Browning. Theophilus Phillips swears before William R. McCord, Clerk on December 31, 1845 that Eliza, Charles, and John Marquand are not residents of Indiana. This petition was filed December 31, 1845. A notice of the suit of petition to be published in the Vincennes Gazette for 3 weeks from January 8, through January 22, 1846 is ordered to be published by W. R. McCord, Clerk. R. Y. Caddington comes before W. R. McCord, Clerk and swears that the notice has been placed. W. R. McCord, Clerk files for guardianship of the minor children of Solomon Marquand and replies to the petition of Theophilus Phillips. Alfred Belwood, Charles Kelly, and George Calhound are appointed Commissioners to make partition of land belonging to heirs of Solomon Marquand and Theopilus Phillips on April 7, 1846. A notation dated August 19, 1846, states that George Calhound and Alfred Belwood swear to their ability to dutifully perform their duty in partitioning the lots. A Commissioners report is sworn on August 18, 1846. It states the property lines and gives a diagram of the property division. The report was filed August 19, 1846.
