Edwin Jones vs Harvey McFarland

Description:	A receipt of E. M. Jones showing he has assumed $5 for Abraham Smith, a receipt for oats, 8 1/2 bushels of potatoes @25 cents a bushel, a cash amount for chairs, beef for Collins, and the rails for Merryshall (Merishall) land. The total of the receipt is $10.57 1/2. An affidavit of accounts by Edwin Jones stating his explanation for the items listed in accounts agreement and payments between himself and Harvey McFarland. Items are 75 cents for 100 rails, clearing land, payments for coal, hauling wood, charges on McFarland for taking flour, bacon, beans, and coal. A Covenant filed February 22, 1841 in which the defendant says though there was a written contract between the parties he has completed his part by clearing 5 acres of land. He says the plaintiff refused to pay $4 per acre due him and that the contract was broken by plaintiff by his refusal to pay. Signed A. H. Lane McCanaughy. The plaintiff reply to the defendant says defendant did not perform his convent to wit as he did not clear 5 acres and that he paid the defendant more than was bound. Signed by Attorneys Judah and Gibson and filed February 22, 1841. A document signed by Martin Robinson, Justice of the Peace listing the costs of court at $7.74 3/4. Martin Robinson J. P. files a transcript of the trial stating that the jury finds for defendant in the amount of $53.5 in damages and costs of suit at $6.81. He states plaintiff has filed for appeal and subpoenas have been issued January 30, 1841 to February 4, 1841. Edwin M. Jones, Henry Wyant and Samuel Gochenour bond themselves unto Harvey McFarland for $100. A petition to the Clerk to subpoena Cyrus Thompson, Pierre Broulett, Milton Edson, Joseph Kirkpatrick, Daniel Dean, Alex Frasier, Sam Green, Stephen Underhill, Evans Brown and Joseph Broden is filed by Attorney Judah. The Clerk was to issue a subpoena for E. M Jones, N. Smith, John Banks, Stephen Underhill. A subpoena on behalf of Edwin Jones is issued for Daniel Dean, Stephen Underhill, and Evan Brown. A subpoena for Cyrus Thompson is issued. A subpoena for Daniel Minard, and Robert Beesley is issued.
