Description:	april 9 1987 city of terre haute 69 the same as a part of the master plan for the city of terre haute indiana providing penalties for violations thereof and declaring an emergency section 1 be it ordained by the common council of the city of terre haute vigo county state of indiana that title iii comprehensive zoning ordinance of general ordinance number 1 1967 effective november 3 1967 entitled an ordinance adopting a comprehensive zoning ordinance for the city of terre haute indiana in accordance with chapter 174 of the acts of the indiana general assembly 1947 as amended designating the same as a part of the master plan for the city of terre haute indiana providing penalties for violations thereof and declaring an emergency and chapter 1161 thereof zoning district maps be and the same is hereby amended to read as follows that the following described real estate situated in the city of terre haute county of vigo state of indiana to-wit beginning on the north line of the south half of the south west quarter of section 2 township 1 2 north range 9 west at a point 278.52 feet west of the northeast corner of the south east quarter of the south west quarter of said section thence west on the north line of said section thence west on the north line of said half 1135.78 feet more or less to the center line of the lafayette road now u.s road no 41 thence southwesterly along the center line of said road a distance of 151.0 feet thence east 161.10 feet to a point 127.8 feet south of the northeast corner of the southwest quarter a distance of 364.8 feet to a point 100.0 feet north of an iron pin in the north right of way line of the chicago milwaukee and st paul railroad companys right of way thence westwardly parallel to the north right of way line of said railroad to the center line of of said lafayette road thence southwesterly along the center line of said lafayette road 117.20 feet more or less to the north right of way line of said railroad thence to the north right of way line line of said railroad 1472.98 feet more or less to a point 278.52 feet west of the east line of said south west quarter thence north to the place of beginning containing 15.64 acres more or less except for that part conveyed to charles a stone and edwin s webster by deed dated march 2 1903 and recorded in deed record 108 page 525 of the records of the recorders office of vigo county indiana commencing at the northeast corner of the southeast quarter of the southwest quarter of section 2 township 12 north range 9 west thence south 35 rods and 20 links thence west 16 rods and 22 links thence north 35 rods and 20 links thence east 16 rods and 22 links to the place of beginning except two acres of even width off the side of the above described tract all of chicago milwaukee and st paul and pacific railroad companys right title and interest in that part of the sw 1/4 of section 2 township 12 north range 9 west lying easterly of the easterly line of lafayette avenue u.s highway 41 westerly of the north-south section of said section 2 and northerly of a line drawn parallel with measured at right angles two and distant 33 feet northerly of said railroad company main track centerline as now there laid and operated across section 2 containing 2.06 acres of land more or less commonly known as real estate situated behind 2101 of lafayette vigo county terre haute indiana be and the same is hereby established as a c-3 regional commerce zone as designated in chapter 1 133.01 of title iii of said ordinance and the same is hereby declared to be a c-3 regional commerce zone in the city of terre haute county of vigo state of indiana together with all rights and privileges that may inure to said real estate and the owners thereof by virtue of the law in such cases provided subject to all limitations and restrictions imposed thereon by deed or otherwise section 2 whereas an emergency exists for the immediate taking effect of the ordinance the same shall be in full force and effect from and after its passage by the common council of terre haute and approval of the mayor and publication as required by law larry w kirchner councilman passed in open council this 9th day of april 1987 ray azar president attest charles p hanley city clerk presented by me to the mayor this 10th day of april 1987 charles p hanley city clerk
