54 journal of the common council regular session and chapter 1161 thereof zoning district maps be and same is hereby amended to read as follows that the following describes real estate situated in the city of terre haute county of vigo state of indiana to-wit all of lot 17 in jewetts first subdivision of eutaw farm being part of the north east quarter and part of the south east quarter of section 22 township 12 north range 9 west except 80 feet off the north end and except 86 feet 6 inches off the south end of said ix>t 17 in terre haute vigo county indiana also part of lot 17 in jewetts subdivision of the north east quarter and part of the south east quarter of section 22 township 12 north range 9 west as shown in plat book 1 at page 4 of the public records of vigo county indiana beginning sixty-two feet north of the south west corner of said lot 17 and running thence north twenty-four 24 feet six inches thence east one hundred forty 140 feet thence south twenty-four 24 feet six inches thence west to the place of beginning also sixty-two 62 feet off the south side of lot number 17 in m.a jewetts subdivision number 1 of eutaw farm as the same appears on the recorded plat of the recorders office of vigo county indiana in plat record 1 page 4 except 10 feet off of the east side thereof dedicated for an alley commonly known as 303-305 north thirteenth street terre haute indiana be and the same is hereby established as a c-2 planned development as designated in chapter 1124 of title iii of said ordinance and the same is hereby declared to be a c-2 planned development of the city of terre haute county of vigo state of indiana together with all rights and privileges that may inure to said real estate and the owners thereof by virtue of the law in such cases provided subject to all limitations and restricts imposed thereon by deed or otherwise except as specifically authorized under the terms of this ordinance a that the real estate described shall be a planned development in a c-2 commercial as the same is defined in the comprehensive zoning ordinance for the city of terre haute indiana subject to the terms and conditions set forth herein b that the real estate described shall be zoned c-2 limited community commerce district along with all rights established for a c-2 district plus the uses of a package liquor sales and residential apartments further this ordinance is contingent on that it will become void if the uses have not materialized within 6 months as of the passage of this ordinance c that the owner will furnish at least twenty-four 24 off-street parking spaces of at least 180 sq ft each on the north side of the property to be completed within six 6 months from the time this ordinance shall become law d that the owner has met all of the criteria determined by the area planning commission and the city council of terre haute indiana that a hardship does exist and that a planned development as set forth herein is hereby approved and will be in the publics interest and in the interest of the neighborhood section 2 that the common council of the city of terre haute indiana hereby grants unto the owners of said real estate described and all future owners of said real estate the following rights privileges and uses of a c-2 planned development commercial as the same are defined pursuant to the terms and conditions of chapter 1124.04 of title iii of the comprehensive zoning ordinance of the city of terre haute indiana as stated in section 1 section 3 whereas the area planning commission has considered a petition filed pursuant to general ordinance no 8 1982 planned development being chapter 1124.03 and whereas special ordinance no 13 1987 as amended has been referred to the area planning commission for its review and consideration and a favorable recommendation has been referred by the commission to the common council and whereas a public hearing on special ordinance no 13 1987 as amended has been held pursuant to chapter 1124.09 of said ordinance and the owners of the real estate described above have demonstrated to the area planning commission and to the common council evidence that a hardship exists pursuant to chapter 1124 of said ordinance be it ordained by the common council of the city of terre haute indiana that the owners of the real estate described have demonstrated that a hardship exists for the use of said real estate and the common council of the city of terre haute now determines that a hardship does exist and specifically authorizes and approves the use of the real estate described in exhibit a as a c-2 planned development as described in this ordinance under the terms and conditions set forth herein and further finds and determines that the proposed use described herein will be in the public interest and that substantial justice will be done section 4 whereas an emergency exists for the immediate taking effect of this ordinance the same shall be in full force and effect from and after its passage by the common council of terre haute and approval of the mayor and publication as required by law |
